Refund & cancellation policy
This page summarizes how payment, cancellation and refunds work for the services of Horus Advisors LLC (trade name Effika). It is a digest of our Terms of Service, whose article numbers are given in brackets. The signed quote and the Terms of Service are the binding documents and prevail over this summary.
Our services are provided to businesses and professionals only. We sell services (consulting, design, development, maintenance and hosting), not physical goods.
When you pay
Quotes. A quote is valid for 30 days. The contract is formed when you return it signed and marked “Approved” (or “Bon pour accord”) [I.2].
Project work. The payment schedule is the one in the quote: full payment on order, a deposit and a balance, or instalments. If the quote says nothing, the full amount is due on order. Invoices are payable on receipt and at the latest 14 days after issue. Work starts once the first payment has been received [I.7].
Maintenance plans. The monthly fee is charged in advance by automatic payment (bank card or another recurring payment method) [II.6]. The amount, frequency and 12-month commitment are stated in the quote you sign; no recurring charge is set up without it. An invoice is issued for each charge.
Cancelling project work
Either party may end a project without giving a reason, with 30 days' written notice [I.15]:
- work already started on the date of notice, including substantial preparatory work, is completed and paid in full;
- work not yet started is dropped, with no compensation on either side;
- any amount you paid in advance for work not yet started is refunded within 30 days.
The parties may also agree in writing to pause a project instead of ending it, setting how long the pause lasts and how work resumes [I.15].
Other cases of termination
- Serious breach. After a formal notice left without effect for 30 days, the other party may terminate. Work performed up to termination remains due, and amounts already paid are kept in proportion to the work done [I.15].
- Force majeure or prolonged unavailability. If an event beyond a party's control, or a prolonged unavailability of the person doing the work, lasts more than 60 days, either party may terminate without compensation. Work performed remains due, and amounts received for work not performed are refunded [I.16].
- Abandoned project. If we receive no material and no reply for 90 consecutive days, we may close the project after a written reminder left unanswered for 15 days. Work performed is invoiced [I.15].
Approval, revisions and defects
Each deliverable includes the number of revision rounds stated in the quote (two to three depending on the medium). Further rounds or a change of direction are quoted separately [I.6].
On completion you have 10 days to report in writing anything that does not match the quote; after that, the work is deemed accepted [I.6].
For 3 months after acceptance, we fix free of charge any reproducible defect within the scope of the quote [I.12].
Cancelling a maintenance plan
- First 12 months. A maintenance plan has a firm initial term of 12 months, during which the monthly price is guaranteed. It can be ended early only for breach, force majeure or prolonged unavailability, or if your business permanently closes (with official proof and 30 days' notice; fees remain due until the end of the notice) [II.7].
- After 12 months. The plan then continues for an indefinite term. Either party can end it in writing with 3 months' notice; the fee remains due during the notice period [II.7].
- Price change. We may change the price with one month's notice, never during the initial term. If you refuse the new price, you may cancel without notice on the date it takes effect [II.6].
- Failed payment. If an automatic payment fails, you have 10 days to fix it. After a formal notice left without effect for another 10 days, the service may be suspended; the fees due remain payable [II.6].
What you keep when you leave
When a maintenance plan ends, we hand over at no extra cost a complete archive of the files and source code, a full export of the database, the list of third-party services used and, for accounts in your name, their credentials [II.8].
Your domain name is yours. It is transferred on first request and is never withheld, even in case of dispute; only registry fees can be charged [II.4].
Your site stays online during the notice period. Data is kept for 90 days after the end of the contract for restitution, then deleted [II.8].
Rights in the work we created for you are transferred as each item is paid in full [I.8].
Late payment
For project invoices: a reminder from the day after the due date, a formal reminder at day 30, a formal notice at day 45, and suspension of the work and access related to the unpaid quote at day 60. Late payments bear interest at the European Central Bank refinancing rate plus 10 percentage points, plus a fixed €40 recovery fee [I.7]. Hosted services under a maintenance plan are suspended only if the maintenance fees themselves are unpaid [I.7].
Right of withdrawal
Because our services are reserved for professionals, the consumer cooling-off period does not apply. Where a client established in France exceptionally benefits from the right of withdrawal under Article L221-3 of the French Consumer Code, it asks us to start work immediately; the right is then lost once the services are fully performed, and the services performed before withdrawal remain payable [I.2].
How refunds are paid
Refunds are made to the original payment method where possible, otherwise by bank transfer to an account you designate, in the currency of the original payment, within 30 days.
Billing questions and disputes
If you have a question about a charge or believe a charge is incorrect, contact us at contact@horus-advisors.com before contacting your bank. We reply within 10 business days and refund in full any amount charged in error, such as a duplicate charge.
How to give notice
To end a contract, send written notice to contact@horus-advisors.com, stating the quote concerned. The notice periods above run from that notice [I.15, II.7].
